Terms and conditions of the IMPORT-UA TOURIST STORE online store
It defines, among other things, the rules of concluding sales agreements through the store, containing the most important information about the seller, the store and the consumer's rights.

§ 1 DEFINITIONS
Business days - days from Monday to Friday with the exception of public holidays.
Account - regulated by separate regulations free-of-charge Store function (service provided electronically), through which the Buyer
may set up their individual Account in the Store.
Consumer - Consumer within the meaning of the Civil Code.
Buyer - any entity purchasing in the Store.
Regulations - these regulations.
Store - the online store TOURIST STORE IMPORT-UA operated by the Seller at http://www.import-ua.com.

§ 3 TECHNICAL REQUIREMENTS
1. For proper functioning of the Store it is necessary to:

2. To place an order in the Store, in addition to the requirements specified in paragraph 1, it is necessary to have an active e-mail account.
§ 4 IN-STORE SHOPPING
1. Prices of goods visible in the Store are total prices for the goods, including VAT.
2. Seller points out that the total price of the order consists of the price of the goods indicated in the Store and the cost of delivery of the goods.
3. The product you have chosen to buy should be added to the basket in the Store.
4. Then the Buyer chooses from the available in the Shop: a way of delivery of goods and a method of payment for the order and gives the data
necessary to complete the order.
5. An order is placed when the Buyer confirms its contents and accepts the Regulations.
6. Placing an order is the same as concluding a sales agreement between the Buyer and the Seller.
7. The Seller shall provide the Consumer with a confirmation of the conclusion of the sales contract on a durable medium at the latest upon delivery of
goods.
8. The Buyer may register with the Store, i.e. open an Account or make purchases without registering by providing his
data with each possible order.
§ 5 PAYMENTS
1. You can pay for your order:
a. By ordinary bank transfer to the Seller's bank account.
b. With a payment card:

c. Through a payment platform:
PayPal
TPay.com
d. Cash on delivery, i.e. at the time of delivery of goods to the Buyer.
2. If the Buyer chooses to pay in advance, the order must be paid for within 5 working days of placing it
order.
3. The Seller informs that in case of some payment methods, due to their specificity, paying for an order with this method is
possible only directly after placing the order.
§ 6 FULFILMENT OF ORDER
1. The seller is obliged to deliver goods without defects.
2. The order lead time is indicated in the Shop.
3. If the Buyer has chosen to pay in advance for the order, the Seller will proceed to carry out the order after it has been paid.
4. If within one order the Buyer has purchased goods with different lead times, the order shall be completed within
the deadline applicable to the goods with the longest lead time.
5. Goods purchased in the Store are delivered exclusively in the Republic of Poland, depending on which method of delivery

b. To parcel machines InPost

§ 7 RIGHT OF WITHDRAWAL
1. Konsumentowi przysługuje prawo odstąpienia od umowy zawartej ze Sprzedawcą za pośrednictwem Sklepu, z zastrzeżeniem § 8 Regulaminu w terminie
14 dni bez podania przyczyny.
2. The withdrawal period expires after 14 days from:
a. On which the Consumer has acquired possession of the goods or on which a third party other than the carrier and indicated by the Consumer
has acquired possession of the goods.
b. On which the Consumer has acquired possession of the last of the goods or on which a third party other than the carrier and indicated by

3. In order for the Consumer to exercise his right of withdrawal he must inform the Seller, using the data specified in § 2
Regulations, of his decision to withdraw from the contract by an unequivocal statement (for example, a letter sent by post or
information sent by e-mail).

EFFECTS OF WITHDRAWAL
6. In the case of withdrawal from the contract the Seller returns to the Consumer all payments received from him, including the costs
delivery of goods (with the exception of additional costs arising from the chosen by the Consumer way of delivery other than
cheapest standard delivery method offered by the Seller), immediately, and in any case not later than 14 days from the day on which the Seller was informed of the Consumer's decision to withdraw from the concluded agreement.

7. Reimbursement of payments will be made by the Seller using the same methods of payment that were used by the Consumer in the original transaction

if the Consumer sends back the goods before the expiry of the 14-day period.
10. The consumer shall bear the direct costs of returning the goods.
11. The consumer is liable only for diminished value of the goods resulting from the use of the goods in a manner other than that necessary to
to ascertain the nature, characteristics and functioning of the goods.
12. If the goods, due to their nature, cannot be returned in the usual way by post, the consumer will also have to bear
direct costs of returning the goods. The estimated amount of these costs the Consumer will be informed by the Seller in
the description of the goods in the Shop or when placing an order.
13. In case there is a need to reimburse the funds for a transaction made by the customer with a payment card, the seller shall make the reimbursement
to the bank account assigned to the payment card of the buyer.
§ 8 EXCEPTIONS TO THE RIGHT OF WITHDRAWAL
1. The right of withdrawal from a distance contract does not apply to the consumer in relation to the contract:
a. In which the subject of the performance is a non-reproduced thing, produced according to consumer's specification or serving
satisfy his/her individual needs.
b. In which the object of performance is a perishable item or an item with a short shelf life.
c. In which the subject matter of the performance is an item delivered in a sealed package that cannot be returned after opening the package
can be returned for health or hygiene reasons, if the packaging has been opened after delivery.
d. In which the subject matter of the performance are things which after delivery, due to their nature are inseparable from
other things.
e. In which the subject matter of the provision are sound or visual recordings or computer programs delivered in sealed packaging
if the packaging was opened after delivery.
f. For the supply of newspapers, periodicals or magazines, except for a subscription contract.
g. In which the price or remuneration depends on fluctuations in the financial market which are not controlled by the trader and which
may occur before the end of the withdrawal period.
h. For the supply of digital content which is not recorded on a tangible medium if performance has begun with
with the consumer's express consent before the expiry of the withdrawal period and after having been informed by the trader about the loss of
of the right of withdrawal.
2. The right of withdrawal from a distance contract does not apply to an entity other than the Consumer.
§ 9 COMPLAINTS
1. In case of a defect in the goods, the buyer has the right to claim the defective goods on the basis of the warranty or guarantee regulated in the Civil Code
Civil Code under warranty or guarantee, provided that the guarantee has been granted.
2. Using the warranty, the Buyer may, on the terms and within the time limits specified in the Civil Code:
a. Submit a price reduction declaration.
b. In the case of a material defect, make a statement of withdrawal from the contract.
c. Require the item to be replaced by one free of defects.
d. Demand removal of the defect.
3. The Seller requests that complaints on the basis of the warranty be submitted to the postal or electronic address specified in § 2 of the Terms and Conditions.
4. If it turns out that in order to consider the complaint it is necessary to deliver the advertised goods to the Seller, the Buyer is
to deliver the goods, in case of a Consumer at the expense of the Seller, to the address Okszowska 39 Street (store with pontoons)
22-100 Chelm.
5th If the goods have an additional warranty, information about it, as well as the conditions, is available in the product description in the
Store.
6. Complaints concerning the functioning of the Store should be sent to the e-mail address specified in § 2 of the Regulations.
7. The complaint will be considered by the Seller within 14 days.
OUT-OF-COURT COMPLAINT AND REDRESS PROCEDURES
8. In the event that the complaint procedure fails to produce the result expected by the Consumer, the Consumer may use
inter alia:
a. Mediation conducted by the appropriate Regional Inspectorate of Trade Inspection, to which one should apply with
request for mediation. As a rule, the proceedings are free of charge. The list of Inspectorates can be found here:

b. Help from a permanent amicable consumer court operating at the Provincial Trade Inspection Inspectorate
The court must be requested to consider the case before the arbitration court. As a rule, the proceedings are

c. Free assistance from a municipal or district consumer ombudsman.

§ 10 PERSONAL DATA
1. The administrator of the personal data provided by the Buyer while using the Shop is the Seller.
2. The Buyer's personal data is processed mainly on the basis of the contract and for the purpose of its implementation, in accordance with the principles set out in
General Regulation of the European Parliament and of the Council (EU) on data protection (RODO).
3. Detailed information on data processing by the Seller is contained in the privacy policy located in the Shop.
§ 11 DISCLAIMERS
1. It is forbidden for the Buyer to provide content of an unlawful nature.
2. Each order placed in the Store constitutes a separate contract of sale and requires a separate acceptance of the terms and conditions. Agreement
is concluded for a period and for the purpose of the order.
3. Contracts concluded on the basis of these Regulations shall be executed in the Polish language..
4. In case of a possible dispute with a Buyer who is not a Consumer, the competent court will be the court having jurisdiction over the registered office of
Seller.
5. None of the provisions of these Regulations shall exclude or in any way restrict the rights of the Consumer arising from
provisions of law.
6. The provisions relating to goods shall apply mutatis mutandis to digital content, unless these Terms of Use specify these matters separately.
